These Terms of Service ("Agreement" or "Terms") govern your access to and use of our website located at www.deliriumphl.com (the "Site"), as well as any purchases, subscriptions, SMS communications, and services offered through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.
1. Acceptance of Terms
By using our Site, creating an account, making a purchase, or subscribing to any of our communications, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
We reserve the right to update or modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.
2. Use of Our Website
Our website is intended for personal, non-commercial use. By using our Site, you agree to:

3. Orders and Payment
By placing an order on our Site, you represent that you are authorized to use the payment method provided and that all information submitted is accurate.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or product unavailability.
All prices are listed in U.S. dollars. Applicable taxes and shipping fees will be calculated and displayed at checkout. Payment is due in full at the time of purchase.
4. Custom and Made-to-Order Items
Many of our products are custom-made or made-to-order specifically for you. By placing an order for a custom or made-to-order item, you acknowledge and agree to the following:
• Custom orders begin production promptly after payment is received and confirmed
• Custom and made-to-order items are non-refundable and non-exchangeable unless they arrive damaged or defective (see Section 5)
• It is your responsibility to provide accurate customization details at the time of ordering
• Production and shipping timelines for custom items are estimates and may vary
• Design approvals, if required, must be confirmed within 48 hours of our request
If you have questions about your custom order status, please contact us before placing your order.
5. Returns, Refunds, and Exchanges
Standard Items
We accept returns on eligible standard (non-custom) items within 14 days of delivery. To be eligible:
• Item must be unused, unworn, and in original condition with tags attached
• You must contact us before sending a return
• Return shipping costs are the customer’s responsibility unless the item is defective or incorrect
Approved refunds will be processed to your original payment method within 5–10 business days.
Custom and Made-to-Order Items
These are final sale and not eligible for returns or refunds except if:
• Item arrives damaged or defective
• Item does not match approved design/specifications
Contact us within 30 days of delivery with photos and we will resolve the issue.
Digital Downloads
All digital purchases are final sale and non-refundable once delivered or accessed. If you experience issues, contact us within 48 hours.
Damaged or Incorrect Items
If you receive a damaged, defective, or incorrect item, contact us within 30 days at deliriumphl@gmail.com with your order number and photos. We will arrange a replacement or refund.
6. Digital Downloads
We may offer digital products such as files, graphics, or templates. By purchasing, you agree:
• Products are delivered electronically after purchase
• You receive a limited, non-exclusive, non-transferable license for personal or internal business use
• You may not resell, share, or redistribute digital products
• All digital content is protected by copyright
We reserve the right to revoke access if terms are violated.
7. Subscriptions
If we offer subscription services:
• Subscriptions renew automatically unless cancelled
• You authorize recurring charges to your payment method
• Pricing may change with notice
• You may cancel anytime, effective at the end of the billing period
• No prorated refunds unless stated otherwise

By providing your phone number and opting in, you consent to receive recurring automated marketing messages from Delirium, including promotions, cart reminders, and updates.

9. Intellectual Property

• Merchantability or fitness for a particular purpose
• Uninterrupted or error-free operation

Some limitations may not apply depending on your jurisdiction.
11. Limitation of Liability
To the fullest extent permitted by law, Delirium shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site.
Our total liability shall not exceed the amount you paid to us in the 90 days prior to the claim.
12. Indemnification
You agree to indemnify and hold harmless Delirium from any claims, damages, or expenses arising from:
• Your use of the Site
• Your violation of these Terms
• Your violation of any third-party rights
13. Governing Law and Dispute Resolution

Any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be handled through binding arbitration.
You agree that disputes will be handled individually and not as part of a class action.
